Terms & Conditions (the boring legal stuff)

Please read these terms and conditions of booking and hire carefully as they contain important information regarding your legal rights, remedies and obligations.  These terms and conditions ("Terms") govern the provision of services by Touch of Purple Pty. Ltd. atf Touch of Purple Unit Trust t/a Atomic Beats Entertainment and any associated parties, hereafter referred to as "the Company" to the customer, hereafter referred to as "the Customer".  By engaging the services of the Company, the Customer agrees to be bound by these Terms.

  • The Company agrees to provide DJ and/or Photo Booth services as specified in the booking confirmation and details shown on the invoice sent to the Customer.
  • The Customer agrees to provide the Company with all necessary information and details regarding the Customer's event, including date, time, location and any other location specific details to assist and enable the Company to provide the Company's services.
  • The Customer agrees to provide the Company and its staff with accurate information about the Customer's event.  This includes any necessary permits, consents or approvals required to undertake the event and the Company is not liable for any failure to obtain such permits, consents or approvals.
  • In the unlikely event (and we do stress unlikely, such as severe illness or injury) the Company's staff become unavailable due to unforeseen circumstances, the Company will provide the Customer with a full refund of any monies already paid.
  • The Company's DJ and Photo Booth services are hired at a flat rate fee, for a time frame and fee agreed between the Company and the Customer.  
  • The Customer may request and discuss additional time (referred to as overtime) with the Company's staff at the event.  Overtime services are at the discretion and availability of your DJ or Photo Booth attendant, the overtime rate is $200 per hour and must be paid prior to commencement of overtime period.
  • The Company will make every reasonable effort to provide and supply the agreed-upon services to the best of its ability.  The customer understands and acknowledges that the overall success of the event may depend on circumstances which are beyond the control of the Company, such as and including guest behaviour, event facilities and/or technical issues.
  • The Company's staff will wear Company identifying clothing/uniform during the event.  This easily identifies our staff to both you and your guests.
  • The Company cannot and does not control the conditions or legality of any venue/property where an event is held.  The Company is not responsible for, and remove any and all liability related to any venues and or properties.
  • To the fullest extent permissible by law, the Company and its employees are excluded from all liability for direct, indirect and consequential and or incidental damages, loss of profits or savings or damages resulting from loss of expectation or any other loss or damage, suffered by the Customer in relation to booking an event.
  • The Customer agrees to indemnify the Company and the Company's staff to the fullest extent permissible by law, for any costs, expenses, losses, damages suffered or any claims made by the Customer or third parties to the Indemnified arising out of the event, for any reason, or out of breach of these Terms and any act or omission of the Customer in connection with the services or event.
  • The Company does have current insurance coverage and the Company can supply a Certificate of Currency if requested.
  • In the event that the Company is liable to a Customer, the Company's liability will be limited to refunding any monies paid by the Customer in relation to the services in respect of the which the claim arose.
  • The Customer is required and responsible to ensure the event's venue has appropriate access, electricity supply within 10 metres of where the Company's equipment is to be setup and operated, under-cover area for the Company's equipment to operate, suitable parking for the Company's staff, adequate space for DJ and Photo Booth set up (2mx2m for DJ and 3mx3m for Photo Booth).  Any costs or expenses incurred to provide these facilities shall be the responsibility of the Customer.
  • The Customer is responsible for providing the Company's staff with a safe performance area.  The Company is not liable for any damage as a result of a failure to maintain a safe performance area or damage incurred by the Customer as a result of the Customer providing an unsafe performance area.
  • A booking is deemed to be confirmed when the Customer has accepted the Company's quote, paid a 30% non-refundable deposit and supplied all event details.  The payment of the 30% deposit, secures the date, time and services of the Company for the Customer's event.
  • Final payment (balance payment) for the event is outlined on the invoice provided to the Customer after the 30% non-refundable deposit has been paid.
  • Final balance payment for the event is due prior to or on the day of the event, prior to the Company commencing any equipment set-up.  Final payment can be made by either bank deposit (OSKO), cash or tap pay (via Square Online).  
  • The Company's staff are authorised to accept the final payment from the Customer (or the Customer's representative) at the event and prior to equipment set-up.
  • In the event the Customer cannot or does not make the final balance payment by the event's date and prior to equipment set-up, the Company may regrettably need to withdraw their services and staff from the event.
  • Deposit is non-refundable.  If the event is cancelled or postponed, any fees paid are not refundable.  The Company may agree to rescheduling the event if the Customer is able to provide an alternative date and time, which is also agreeable to the Company's existing schedule of availability.
  • The Company reserves the right to cancel its services if the Customer is in breach of these Terms or for reasons beyond the Company's control.  In such cases, the Company will refund the Customer's deposit, but the Company is not liable for any additional compensations or damages.
  • Company Equipment: The Customer may be held responsible for any damage to the Company's equipment which has been found to be caused by either the Customer, guests or any third party during the event.
  • The safety and respect for the Company's staff is always paramount.  The Company does not tolerate unsociable behaviour, abuse, drunken, rowdy or potentially life and property threatening behaviour.  If there is unsociable behaviour, the Company reserves the right to terminate services.  No refunds will be provided.  The Customer agrees to provide a safe working environment for the Company's staff at the event.
  • The Company may collect and store the Customer's personal details for the purpose of providing event services.  The Company will not share this information with third parties, except as may be necessary for event planning and operation.
  • The Customer agrees to provide food and refreshments during the event to the Company's staff.
  • The Customer agrees to send any specific music requests to the company at least one week before the event's date.  Music requests can be made at the event, and every effort will be made to play the requests, but the Company cannot always guarantee these requests are played due to our pre-arranged set list or track availability at the event.
  • The Company's DJ and/or Photo Booth staff will arrive early at the event to help ensure a smooth and easy set-up and to also test our equipment prior to your guests arriving.  We will normally endeavour to arrive at least two hours before the Customer's event.  At times there may be factors which could delay the arrival of our staff, the Company is not liable for any damage or loss as a result of unexpected late arrival.
  • Images shown throughout this website may be generic and not of actual events performed by the Company.
  • During the Company's DJ booking events, the Company does use a range of special lighting and effects.  These may include flashing lights, laser lighting effects and strobe lighting.  Some lighting used may be disruptive to people who are sensitive to light, or may affect people with epilepsy (seizures).  The Customer is made aware of this, and the Customer should notify guests attending their event.
  • The Company's Photo Booth is both portable and easy to operate.  The Company shall, whenever possible provide a Company attendant to operate the Photo Booth and interact with guests.
  • In the event that a Photo Booth Attendant is not available for the Customer's Bronze, Silver or Gold Package Event, the Company shall advise the Customer of this either at the time of making the booking or soon there-after.  In this event, the Company's DJ shall set up the Photo Booth for operation at the event, provide instructions of use and will ensure the Photo Booth is operational throughout the event.
  • For a Bronze, Silver or Gold Package Event where a Photo Booth Attendant is not available, the Company will provide the Customer a 10% discount off the Package price. 
  • In the event that the Company's Pop-Up Photo Booth is not available due to a technical fault and requiring repair, the Company shall advise the Customer and offer our Photo Booth services using our Instax App and Instax Printer along with all our normal hats, props and attendant to take the photos.  The Customer may choose to cancel the booking if this event occurs, and the Company shall provide a full refund paid to the Customer's nominated bank account provided to the Company by either SMS or Email.
  • Any advertised special offers will override any other special pricing or discounts, and only the higher discount offer will apply, not both.
  • The Company does not charge for set-up or pack-up time.  The booking which the Customer makes is for services operating fully during the chosen event times.
  • All prices include GST
  • The Customer agrees and authorises the Company to use photos (taken at the Customer's event by either our Photo Booth or staff) for use on the Company's marketing website and social media pages.  No individual personal details will be shared or posted, other than the event name.  Guests may request for their photos not to shared by the Company.
  • The Company may modify, change or amend these terms, website and fees without notice.
  • These Terms are governed by the laws of Queensland, Australia.
